How Can I Provide for My Pets in My Estate Plan?
Jessica Spenik • Dec 10, 2021

"Such short little lives our pets have to spend with us, and they spend most of it waiting for us to come home each day. It is amazing how much love and laughter they bring into our lives and even how much closer we become with each other because of them.”

- John Grogan

Pet Trusts

Pets are often regarded as members of the family and clients often wonder what will happen to their pets when they are no are no longer living. The Spenik Law Firm is passionate about furry family members and we feel equally passionate about creating a plan for their future care.

Pet trusts are one of the tools we are able to utilize to create a plan for your pet. We often hope that our family or loved ones will be able to care for our pets, but a great Estate Plan plans for the unexpected and ensures that your pets will be cared for under any circumstances.

Florida Pet trusts have three main provisions:

  1. The trust must benefit a pet that is alive during the lifetime of the individual creating the trust, and the trust only operates until the death of the last surviving pet beneficiary.

  2. The terms of the trust may be enforced by:
    * A person appointed by the creator of the trust;
    *If no person was appointed, then by a person appointed by the court.
    *Any person that has an interest in the welfare of the pet(s) may request the court to appoint a person to enforce the trust or to remove a person already appointed.

  3. If the value of the trust exceeds the amount needed to care for the pet(s), except as otherwise provided in the terms of the trust itself, the excess must be distributed to the creator of the trust, if living, otherwise as part of the trust creator’s estate.
